The text below is our user site agreement. These are the terms and conditions required for access to our site. Please read completely before deciding to agree or disagree with these terms.

User Agreement Use of this site signifies your agreement with the following terms of use. If you do not agree with any of these terms of use in the user agreement, please do not use this site. Debtoutlet.com, Inc. dba as debtoutlet.com ("debtoutlet.com") reserves the right, in its sole discretion, to modify these Terms of Use at any time and you agree to be bound by such modifications through your use of the debtoutlet.com site. YOU MUST AGREE TO THESE TERMS AND CONDITIONS BEFORE YOU WILL BE ABLE TO POST OR BID ON AN ITEM. ONCE YOU CLICK THE CONTINUE BUTTON BELOW, YOU AGREE TO THESE SAID TERMS OF THE USER AGREEMENT IN ITS ENTIRETY. -------------------------------------------------------------------------------- Article 1. Eligibility - users of this site must be an adult (18 years old) to trade on this web site and or can legally enter into this Agreement. Article 2. Complience With The Law - You shall comply with all applicable laws, statutes, ordinances and regulations regarding the use of our service and bidding on, listing, purchase and sale of items. Article 3. No guarantees. debtoutlet.com is only providing auction services - We only provide services to people interested in selling and buying debt portfolios and notes via internet auction. We do not have control over the items that are posted in the auction site, and cannot guarantee the authenticity and quality of a said product. Users of this site must do their own due dilegence, We are not responsible for the actions the sellers take, before, during, and after the auction, typographical errors, mis-prints, loss of merchandise/money, damage or failure of equipment, due to your visit to this auction site. Use of this site is at your own risk, and all content is presented 'As-Is'. Article 4. Bidding and Selling - As a user, you may bid and/or sell merchandise on debtoutlet.com . Placing a bid is a binding contract between you and the seller, and the bid cannot be retracted unless due to fault by the seller to inaccurately describe his item that is up for bids. Once you place a bid, and win, it is your obligation to purchase the product at the price you indicated as your final bid. Placing a winning bid at auction, and refusing to complete the transaction is illegal in most states, and there can be legal remedies. By posting an item for bids on debtoutlet.com, you agree that it is a real item and you have described it accurately and honestly. Once your auction has closed successfully with a winning bidder that is above your reserve price you are obligated to complete the transaction to the best of your ability. Sellers must contact the management at Debtoutlet.com to inform management of the transaction and pay the fees that are applicable. Sellers are not allowed to bid on their own auctions. Shill bidding is not tolerated, if reported your auction will can be deleted with no refund on insertion fees. Article 5. Item Restrictions - As a registered user, sellers have the right to submit valid items on this site except those subjects listed below. Sellers should make every reasonable effort to post items that have a category on our website. Nonconforming items can be deleted for any reason without prior notice to seller. debtoutlet.com reserves the right to revoke (block) the privilege of participation for any reason. Complaints about Illegal, Infringing and Questionable Items as those listed below but not limited to the below items, will be handled administratively with users becomming inactive and deleted from this web site. NO Guns or Ammunitiom,NO Obscene X-rated, Pornography or Child Pornography Items. Article 6. Charges - Bidding on an item, and registering are free on this server. Do not abuse this privilege. Article 7. Sellers Fees - Closing and Insertion fees can change at any time. You can see view the fees in the members section of our site. Fees are charged when you have successfully sold your note through debtoutlet.com. It is both the sellers and the buyers responsibility to contact management at debtoutlet.com to confirm that a succesful transaction has occured. Article 8. debtoutlet.com Is Only A Venue - debtoutlet.com is a site that assists sellers and buyers to meet. We do not get involved in the actual transaction between buyer and seller. As a result, we do not have control over the quality or legality of any items that are being auctioned. We can not control whether a person selling an item will complete the transaction or whether a buyer will complete the transaction. There is also a chance you can be doing business with someone under false pretenses. Article 9. Warranty - debtoutlet.com provides this website "as-is", WE AND OUR SUPPLIERS PROVIDE THE debtoutlet.com's ONLINE AUCTION WEBSITE AND OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights which vary from state to state. Article 10. Limited Liability - IN NO EVENT SHALL debtoutlet.com OR OUR SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. OUR LIABILITY, AND THE LIABILITY OF OUR SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO US IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100. Some states do not allow the limitation of liability, so the foregoing limitation may not apply to you. Article 11. No Agency - You and debtoutlet.com are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement. Article 12. General - This Agreement shall be governed in all respects by the laws of the State of New York as such laws are applied to agreements entered into and to be performed entirely within New York. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
